Himachal High Court directs police to consider protection plea of 20-year-old and his 17-year-old wife

Shimla: Himachal Pradesh High Court has come to the aid of a newly-married couple, directing the Superintendent of Police, Sirmaur, and the Station House Officer, Nahan, to consider their request for protection and take appropriate action.

The division bench of Chief Justice G.S. Sandhawalia and Justice Ranjan Sharma passed the order on August 7 while hearing a petition under Article 226 of the Constitution, seeking protection of the couple’s life and personal liberty.

The petitioners — Salman Khan, 20, and his 17-year-old wife — stated they married on July 30, 2025, in Khizrabad, Yamuna Nagar, Haryana, according to Islamic rites, out of their own free will but without family consent.

According to the Aadhaar cards on record, the man was born on August 19, 2004, and the woman on July 1, 2008. The couple contended that under Mohammedan Law, a Muslim female attaining puberty at 15 can marry a person of her choice with her free consent, and such a marriage is not void.

They alleged harassment from private individuals and said they had submitted a representation on August 5 to authorities outlining their security concerns.

The court, relying on the Supreme Court’s ruling in Lata Singh vs. State of U.P. (2006), which affirms the right of consenting adults to marry and live together without unlawful interference, held that a case for intervention was made out.

Accordingly, the bench directed the police authorities to examine the couple’s representation and act in accordance with law, disposing of the petition.
