A three-judge bench of Justices Arun Mishra, S Abdul Nazeer and MR Shah, while explaining the Hindu Succession (Amendment) Act, 2005, said "Daughters cannot be deprived of their right to equality conferred by Section 6 of the Act."
Mr Mishra asserted that "Daughter is always a loving daughter for the rest of their life."
The amendment came into effect on September 9, 2005. The courts considered this as cut-off date to decide please by daughters seeking equal rights as coparceners as sons in their father's estate. It has nothing to do with marriage. (UNI)
