28 yr-old neighbor rapes 6-yr-old girl, sentenced to 20 yrs rigorous imprisonment, to pay Rs. 9 lakh for her rehabilitation

Shimla: The Additional District and Sessions Judge - POCSO Court, Solan has convicted and sentenced a POCSO accused for forcibly committing sexual act with a minor, police said.
As per a statement issued by the district police Solan, the accused was identified as Lakhan, resident of Village and Post Office Bandi, Teh-Mahawan District Mathura.
He was sentenced to rigorous imprisonment for 20 years under Section 4 of POCSO Act and read with section 376 ( 2 ) ( i ) of IPC and fine of Rs 25,000. In default of payment of time, he shall further undergo simple imprisonment for one year.
According to prosecution, in 2017, the child victim went on the roof of her house to answer the call of nature. She was lifted by the accused, who was residing in the adjoining building and taken to his room. The accused committed the sexual assault in a gruesome manner upon the victim in order to satisfy his lust, resulting in injuries on the body of the victim.
On the complaint of her father, a case under Section 376 IPC and POCSO Act against the accused was registered in Police Station, Nalagarh. The case was investigated and the statement of the child was also recorded by the Judicial Magistrate during investigation.
The case, on behalf of the prosecution, was conducted by Sunil Dutt Vasudeva, Special Public Prosecutor.
The Court observed that the minor girl suffered mental trauma and physical pain on account of the act. The said act would have lasting effect on her personality. The 28-year-old accused forced himself upon the six-and-a-half year-old defenseless girl, when she was lonely.
Keeping in view the facts and circumstances of the case, Additional District and Sessions Judge - POCSO Court, Parvinder Singh Arora, recommended payment of compensation to child victim in the sum of Rs nine lakh on account of relief and her rehabilitation.
Out of the total amount, 80 per cent amount of the compensation shall be deposited in shape of FDR in the name of victim and 20 per cent may be disbursed in favour of the victim for her rehabilitation. (UNI)
